Private Equity Funds and Multiemployer Pension Withdrawal Liability

As if the demands imposed by private equity fund due diligence weren’t stringent enough already, now a recent court decision may have made the situation worse.  In a recent court case, Sun Capital Partners v. New England Teamsters Pension Fund, the Massachusetts District Court held two private equity firms responsible for the multiemployer pension withdrawal liability of one of their portfolio companies. This decision was made, despite the two firms having specifically structured the funds to avoid this kind of exposure.
