DOL Finalizes Disability Plan Claims Procedures

The Department of Labor (DOL) recently published a final regulation revising the ERISA claims procedural requirements for disability plans. The new rules include additional protections to provide a full and fair review of disability claims.

In an Alert from Lockton Compliance Services, Rory Akers, JD, explains disability claims have been the subject of extensive litigation. In an effort to ensure consistency, transparency and accountability in disability benefit claims determinations, the DOL published in November 2015 a proposed rule revising the claims procedures regulations. The final rule is substantially similar to the proposed rule.
