DOL disability regulations may require deferred compensation plan changes

While nonqualified plans are generally exempt from ERISA, they are still subject to ERISA’s enforcement provisions.  With the DOL's new regulations, employers with nonqualified deferred compensation plans that allow disability payments, and who make the determination of disability themselves, may need to update their plans before the rules take effect in April.  The latest issue of Retirement Guidance explains more.
